The Supreme Court has upheld the constitutional validity of a Gujarat government notification that prohibited indiscriminate slaughter of bulls and bullocks in the state. A bench of Justices Arijit Pasayat and P Sathasivam dismissed the appeal filed by Abdul Sattar Yusufbhai Qureshi and others who claimed that the impugned notification was violated in their fundamental rights. The said notification was issued on 11th December, 1989 by the state government by exercising its power under the Gujarat Essential Commodities and Cattle (Control) Act for restricting slaughter of the bovine animals. Qureshi and others engaged in meat business challenged the notification that it violated their fundamental right to earn their livelihood but the Gujarat High Court dismissed their plea, following which they appealed in the apex court. Dismissing the appeal, the apex court recalled its earlier rulings wherein the validity of the Bombay Animal Preservation (Gujarat Amendment) Act 1994 was upheld by the Supreme Court. The said Act had also empowered the authorities to restrict slaughter of animals.
