Calcutta HC Orders CBI Probe Into West Bengal Post Poll Violence Cases Of Murder And Rape

The case was of Anindya Sundar Das v. Union of India and other connected matters. The Calcutta HC handed over the investigation of the cases related to murder, rape and crime against women which happened in the State of West Bengal in May 2021 soon after the declaration of the assembly election results to the Central Bureau of Investigation. Acting Chief Justice Rajesh Bindal delivered the lead judgement whereas Justices I.P Mukerji, Harish Tandon and Soumen Sen delivered separate but concurring judgements.

SC: Merely Because An Arrest Can Be Made Lawfully Does Not Mean That Arrest Must Be Made

The case was of Siddharth v. State of Uttar Pradesh. The decision was given by Justices Sanjay Kishan Kaul and Hrishikesh Roy. It was observed that personal liberty is an important aspect of constitutional mandate. Merely because an arrest can be made because it is lawful does not mandate that arrest must be made. A distinction must be made between the existence of the power to arrest and the justification for exercise of it.

Gujarat Freedom Of Religion (Amendment) Act 2021 Won't Apply To Inter Faith Marriages Without Force, Allurement Or Fraudulent Means

In this case, the Gujarat High Court has protected inter-faith marriages based on free consent by adults from undue harassment. It has passed an interim order stating that the provisions of the Gujarat Freedom of Religion (Amendment) Act, 2021, will not apply to inter-faith marriages which take place without force, allurement or fraudulent means. The decision was given by the Division Bench comprising of Chief Justice Vikram Nath and Justice Biren Vaishnav.

Widow Seeks Cancellation Of Bail To Mother In Honour Killing Case

The case was of Mamta Nair v. State of Rajasthan and others. A notice was issued by the Supreme Court in the plea filed by a widow seeking cancellation of the bail granted to her mother in a case of 'honour killing' of her husband. The decision was given by a Bench comprising CJI N V Ramana, Justice Surya Kant and Justice Aniruddha Bose.

Bombay HC: Court Can Interfere In Unconditional Bank Guarantee Only When There Isn't A Slightest Possibility Of Amount's Restitution

According to the Bombay High Court, there can be no interference with an unconditional bank guarantee except when fraud is established or apprehension of irretrievable injustice is demonstrated. The decision was given by Justice G S Patel. The summons for judgment was made absolute and the summary suit was decreed in favour of the plaintiff in the amount of Rs.121.65 lakhs with interest at 6% per annum from the date of the decree till payment or realization.

Allahabad HC: Forensic Science Laboratory Report Need Not Be Proved By Calling It's Director As It Is A Public Document

The case was of Jose Luis Quintanilla Sacristan v. State of U.P. It was held by the Court that a report of State Forensic Science Laboratory is admissible in evidence (as per the provision of Section 293 Cr.P.C.), therefore, there is no requirement to call the Director of that laboratory to get the same proved. The decision was given by Justice Ajay Kumar Tyagi.

Accused Cannot Claim That His Confessional Statement Be Considered Regarding Some Offences Only And Not For Others

The case was of Vinod Mali v. State of U.P. The decision was given by Justice Ajay Tyagi. The Allahabad High Court has recently held that when a conviction is made as a whole regarding any occurrence or set of occurrences, the accused cannot, at a later stage, claim that confessional statement made by him should be considered regarding some of the offences only and not for others.
