Following are the laws which create a liability, if regulations of lockdown are not followed:
Under IPC
1. Section 188
- Refusal to obey regulations made by a public servant, resulting in obstruction or injury or annoyance, punishable with imprisonment up to one month or Rs. 200 fine or both.
- If such disobedience cause danger to life, health and safety, punishable with imprisonment up to 6 months or Rs. 1000 fine or both.
- Cognizable and bailable offence.
2. Section 269
- Person negligently doing an act which is known to likely spread any infection or any disease dangerous to life.
- Punishable for imprisonment of up to 6 months or fine or both.
- Cognizable and bailable offence.
3. Section 271
- Knowingly disobeying any quarantine rule.
- Punishable with imprisonment up to 6 months or fine or both
- Non-cognizable offence.
Under Disaster Management Act
1. Section 51(b)
- Refusal to comply with any direction from the State or the Central government.
- Punishable with imprisonment of up to 1 year or fine or both.
- Such refusal if causes loss of life or danger, punishable with imprisonment of up to 2 years.
2. Section 54
- Circulation of false alarm leading to panic among people.
- Punishable with imprisonment up to 1 year or fine.
3. Section 55
- Offence committed by any department of government, the head of such department will be held liable.
- If such an act was committed with the consent or knowledge of any other officer other than the head, such officer will be held liable.
4. Section 56
- When any officer ceases to perform the duty imposed on him or withdraws himself without any lawful excuse.
- Punishable with imprisonment of up to 1 year or fine.
