Lancy Peris   10 February 2024

Ancestral property

My brother and me own a piece of land in Mangalore. We are based in Mumbai. We are selling this land and will have to travel to Managlore for registration and other sales purposes.  My query is as under:

1. Since we are both party to this deal, can my brother issue a Power of Attorney to me for registration purpose and receipt of monetary gains.

2. Also, since I am one of the signatories, can I also sign on his behalf also.

Require advise please.

1. Yes, your brother can authorise you to sell and carry out other related tasks in this regard by giving a power of attorney deed in your favor duly registered before the jurisdictional registrar at Mumbai.

2. You can sign and execute the registered  sale deed on your behalf and also on behalf of your brother on the basis of the GPA document executed in your favor.
