Session Court has given following order on the Anticipatory bail application of the applicant. Money part promised was not consulted by lawyer with the applicant as applicant was not present in the court. Please advise the option available with the applicant as he is unable to pay the amount mentioned in the order.
Counsel for the applicant during the course of argument has submitted that applicant is prepared to deposit a sum of Rs. 3 lacs without prejudice to the rights and contentions and subject to adjustment in final settlement provided the complainant party does not oppose the request for anticipatory bail of the applicant as well as his family members. The same is acceptable to other side. Accordingly, to come up on XX.XX.XXX for bringing an amount of Rs. 3 lacs to be paid to the complainant which will be without prejudice to the respective rights of the parties and further subject to adjustment in final settlement and also subject to the condition that applicant and his family members shall be entitled to grant of relief of anticipatory bail. Till then applicant as well as his family members be not arrested.
