Calculation of gratuity

One of my employee has worked in my firm for 20 years. Out of these 20 years, he has worked for 12 years for 240 or more days and for rest of 8 years he has worked less then 240 days. My query is whether he is eligible to get gratuity for entire 20 years of service or only for 12 years.

The 240 days criteria is relevant in the stage of initial eligibility and once the eligibility criteria is fulfilled, the calculation will be on the bais of total years of service. Calculation cannot be split year on year based on number of days work in each year.

if employee not fulfilled this criteria of 240 days for 8 years,then also he is eligible for 20 years gratuity ?


if eligible then why there is 240 days criteria.?
