Can built house on father's property

My Father  had 2 brothers and we have done property/house separation 3 years back.  my father and my aunty jointly holding one land. My father had given me permision to build house in land which he is owning in writting( in front of resgistar)  . Last year I lost my father.  if I start building my house on land which father had permitted , My elder brother may create nuisense . can he  challenge in court or can he stop house building work. ? (he is aware that I got legal permission from father and my aunty also given me permision to build house.) a part from father's permmision do I need any document so He can not create any problem.

Mahesh,

You have said that you "have got permission from you father and aunt in front of the registrar."

I hope it means that you have a registered document giving you this permission. If you have the registered document and it contains the terms and conditions on which you were given permission to build then as long as you follow them, your brother may be unable to trouble you.

 

But if the permission is not available in the form of registered document, then you should take consent of all the heirs in writing and register the same.

In any case even if you have the registered permission from your father and aunt, I would advise you to carry out the work only after you discuss with your family members internally..
