Denial of issuing experience letter




Hi, 

This is Sneha Shaw, Emp Id: 718929, worked in ABC Company from 06.06.11 to 08.12.11. 
I was forced to resign on 28.11.11 by my supervisor, as he said there is no position available now, so I can't continue in this organization, anyways I resigned and my resignation got accepted on 08.12.11 and I left the job on that day only. 

I couldn't serve notice. And I didn't receive any mail to complete F&F settlement so far. 
Now today I need to submit experience letter in my current organization for carrier growth. 
So I contacted the HR Team of Igate, and requested the FnF Settlement, I was sent the FnF form and was told they cant send me the experience letter, I'll only get the absconding letter. 

I am ready to pay the amount but HR said after paying the amount he is going to give me the absconding letter only, not the experience letter or the relieving letter, even though I'll pay the full notice period amount. 
Pls advise me.

What were you doing from 8.12.2011.  It is almost  two and half years.  Atleast now you give a complaint in Labour Commissioner stating all the facts you narrated in your query and the reason for the delay caused in giving complaint.  You will definitely get relief.

The HR is not the final authority in the company.  You have to send a registered letter to the top management of the company seeking the desired letter and in that you should narrate the events that forced you to resign the employment as well as the arrogant reply of HR over the issue and you should make it clear that in case of no proper response, you may have to take the legal route to get the relief. After that you may approach the appropriate legal forum for necessary relief and remedy.
