Family property dispute

 

My grandfather were three brothers all residing in joint family. Since they all residing with parents in good harmony, at that time my grandfather purchased some land in town in the name of his elder brother & constructed housed. They also purchased some agriculture Land in the name of elder brother. Later on all three brothers shifted to different home located in same place belongs to his father. They also divided all property based on the some Punchnama, created by them.  The house which was in the town, was not divided, but only rent was divided by them.

 

Everything was going Normal till last year. My grant father died on March 2010 & my father also died on july 2011. We do not know anything about papers of any land purchased by them or family property. When I told them to show the Punchnama, they told that I don’t have any such papers.

 

I want to know that:

1.      How can i get the share in the property purchased by my grandfather in the name of his elder brother?

2.      Can they deny giving us property which is in the name of my Great grant pa & great grant ma?

 

My opinion is, if there is no such Punchnama, then all transaction happened in joint family, all has equals right and it is still a joint family, since there is no any such papers available which can verify that they have divided the all property & residing individually.

 

Pls suggest Me.

My Grandfather had purchased a land, he had 6 children 2 girls 4 boys. Out of 2 girls 1 is no more & the other one is married.Out of 4 boys first 2 are nomore.

Now uncle wants to sell off the land. but my dad soes not want to. we do not have the original docs of the land. but we do have a certified copy of the original docs.

we had a party who was ready to buy our land but that deal did not work out. we have now done a partition deed. 2 portions come to my father & the rest 2 to my elder uncle & another to my younger uncle.

we do not want to sell our piece of land now. we want to construct house & stay there. can we do it..? can they put a stay..? or can they interfear..?
