Subject: Application to take action against Food & Supplies Department officials and Depot holder of Village Bhabiana for Registering Fake F.I.R. of loss of Record and providing Misleading information and hotch-potching Ration and Kerosene earmarked for Public by State & Central Government providing LOSS TO STATE EXCHEQUER
Sir,
In continuation with the Inspection Report submitted on 16th November 2010, I submit as under.
1. That The cancellation order of Mr. Mohinder Singh Depot holder, Licenece No. :PDS/KPT-230 of Bhabiana Village under the provision of Section 3 of Essential Commodities Act, 1955 and under the provision of Punjab Public Distribution System (Licencing & Control) order 2003 and by the order of the licensing authority Smt. Rajneesh Kaur District Contoller, Civil Supplies and Consumer Affairs, Kapurthala vide Ref No. Distribution/2010/3812 dated 03-11-2010 should be implemented with Termination order alongwith the cancellation of the Licence of the said depot holder and the supplies of the essential commodities should be terminated to the said depot holder hence forth.
2. The order of licensing authority should be converted to cancellation of Licence and termination of Supplies of Mr. Mohinder Singh, said Depot holder, Licence No PDS/KPT-230 Village Bhabaiana which had been ordered to upheld the supply of the Essential commodities till further orders.
3. In the appeal is again made to the appellate authority regarding the action taken on the Deficiencies pointed out in Inspection Report submitted on 16/11/2010. The copy of inspection report is once again submitted for the speedy action in this regard.
4. The license has been cancelled on the ground that the Depot holder had violated the conditions of license of the depot, The Depot holder in connivance with the Food & Supplies department officials and Sarpanch Bhabiana had prepared fake Ration cards and the ration, essential commodities like Kerosene and the Ration especially marked for the people of the village had been hotch-potched by the department officials and the Depot holders.
5. The case had been highlighted and the information under RTI Act, 2005 sought but due to the nexus of the Depot holders and the officials of the Food & Supplies department the fake Registration of F.I.R. had been made in the Police Station about the loss of the said record.
6. The investigation in the matter should be marked and the FIR kindly be lodged against the offenders those had been tool in getting the fake F.I.R. lodged with the Police Station, as the statement just two days before the date of hearing fixed before the State Information Commission is untrue and unsatisfactory.
7. The defence of the Depot holder and the officials of the Department of Food and Supplies, Phagwara that have not having in their record the monthly statements which are mandatory to be filed by the depot holders prove that the Department of Food and Supplies have hands in glove to hotch-potch the Ration and Essential commodities meant for the Deprived section of Society.
8. The Report of loss of record is fake as the Department officials and Depot holder failed to stick to their statements.
9. The fake story also proves because the licensing authority also admit that there is conspiracy in the statement of the Depot holder and the appellate authority is requested to take action and Register F.I.R. against the said depot holder to investigate the matter of loss of document and the list of documents those have been lost in transit as per the depot holder’s report to Police should be investigated.
10. The learned Distict Food & Supplies Controller, by the impugned order, suspended the supply of Depot holder, it is requested to the Appellate Authority to kindly investigate the matter and interfere with the concurrent findings of facts, statements recorded by Police and with the licensing authority and take appropriate action against the Depot holder and the negligent staff those have not adhered to the rules framed by the department.
11. As pointed above, the investigations in the matter of loss of records is a pure finding of fact and on the basis of the true picture and on tracing out of relevant material and record, the high scale corruption will be unearthed
12. Due to the urgency of the facts it is requested that the appellant’s application should be considered on facts so that the application for further investigations in the matter should not be referred to Central Vigilance Commission and State Vigilance Commission for further investigation in the matter
13. As this is the acceptance of the Depot holder and the officials of the department while accepting the finding of fact during inspection by the appellant and it was proved and the officials admitted that it was the first offence and was therefore liable to be compounded under Section 100 of the Code of Criminal Procedure of 1973 (2 of 1974) relating to search and seizure of the documents and the premises of the Depot holder for further investigation.
14. Under the facts and circumstances of the case, I pray to the Honourable Director-Cum- Appellate Authority, Chandigarh to kindly take action under the provisions of the act. So, this REMINDER is being filed in continuation of the application filed on 14th Nov 2010 for further criminal and Civil proceedings against the guilty officials and the Depot holder..
