Gift deed

hi...i have a query regarding a gift deed...my mother in law's brother wants to gift a house to my mother in law...the problem is the brother is in the USA and my mother in law and the property are both in india...is there any way that the property can be registered in india without them coming to india...the said house is in the brother and his wife's name...thank you

Dear Querist,

Yes it can certainly be done, your mother-in-law's brother would have to execute a General Power of Attorney (notarized by Indian Consul in US) authorising any person to sell the property to your mother-in-law on his behalf. The person so authorised can then go on with the registration/sale formalities.

actually at the moment my mom in law has d power of attorney for the house...n it was done wen they had come to india...wats to b done
