Joint holding of property with parents

Hi,

We are owning 2 houses in suburbs of Mumbai. In the first house - my brother jointly owns the same with my father. In the second house, I own it with my mother. The family understanding is that the first house belongs to my brother & the second house belongs to me.

After my parents are no more, can I claim stake in my brother's propoerty? & vice versa?

How to avoid that?

Secondly, in the event of my unfortunate death, what are the rights of my wife & kids on the flat?

Please advice.

You can claim your and your mother's share in the father's share in joint property, which is in the name of your father and brother.
