HI,
I would be buying the property in joint with husband,i am a salaried women but my salary cap was not suffcient to fetch the loan amount from the bank because of which i had to enter the joint venture,
Now the loan amount would be deducted 50-50 from my salary and husband salary ,Now since the major amount for this property purchase is from from my dad,and remaining is from the bank loan.
Now i would be signing MOU between me and Husband ,stating that in case of divorce The complete right of the property would be hand over to me and i would be taking the loan amount over and i would repaying it .
Now since the property papers in custody of the bank i wanted to know using MOU can i approach the bank will it be valid one .And will i have any problem if i want to sell the property.During the time of resale would i require my husband signature if in case in am divorced or using the The MOU can i sell it/OR i should be taking the Power of attoerny from my husband stating that i have full right on the property and i can sell the property .please advise me
