Notice Period

My appointment letter has a notice period of 6 months and does not mention anything about the "pay in lieu of notice period", so if I resign by giving one month notice, should I pay for the remaining notice period?

Please give your valuable suggestions

Thanks,

Venka

Yes. When the period is stipulated and the compensation part is silent it becomes arbitrary.  If the company insist you can bargain and come to a compromise.

Dear Gundlapallis,

Thanks for your input, but how can this be leagally correct, as they have not mentioned any penalty for the notice period, and also I would like to know in case they ask me to pay for the notice period, will it be CTC or Basic + DA, as again nothing is mentioned in the appointment letter and I have not been given any HR policy or there is no circular on this.

Thanks,

Madhu

If everything is perfectly mentioned then there is no room for confusion.  Since there is no mention of what or how, the compensation should be. or calculated in the agreement (LoA) the issue becomes arbitrary.  You just talk with your HR, sometimes they may not be interested in asking for any compensation at all.
