I am getting into an agreement to buy a property in Thane, Maharashtra.
The seller has signed the sale agreement & his thumb impression next to his photo on the sale agreement. However, we couldn't execute or register the property before he had to fly to USA. He has sent a power of attorney signed & stamped by US public notary on his nephew's name.
Do we need to register this power of attorney in Maharashtra if it is going to be used for execution purpose?
The power of attorney mentions that it has been given for sale of the seller's apartment which is causing confusion & the seller's nephew is being asked to register the Power of attorney.
Is it enough if we notarise I in Maharashtra on 500 bucks stamp paper?
The sale agreement though signed will have seller's nephews picture during execution & we will attach the original power of attorney to it.
Will this suffice or does the seller still have to wheel 5% stamp duty to register the power of attorney & then we register the sale agreement?
