respected advocates!
i ve query about sec. 311 of cr.pc.
there is case against me of sec 138 ni act.
the complainant has served an affidavit for evidence. it took on record by the court.
now i came to know that the affidavit served by the complnt is actually of another case against me which has the same title and the same court and the case is on the stage of issue notice.
now the complnt served an application of sec 311 cr p c before the court to take permission of another affidavit of complnt for evidence.
i just want to know that
can camplant serve such application under sec. 311 crpc for fresh affidavit in evidence?
is there any ruling of SC not to permit him?
