my father lent amount in the year 1998 on promissory note.the debtor stopped paying interest from april 2000.he got the promissory note renewed (within 3 yrs.)in 2001.as unable to collect money from the debtor he filed a suit in 2003 attaching house before judgment.later my father died in 2006.he transferred the promissory note to me in 2004 due to illness. the court passed decree in my favour in 2007.in EP proceedings i came to know that the debtor gifted his agricultural lands to his wife and the house to his father in 2001 itself.can u pl. guide me how to proceed in this case? my lawyer is telling that since his(debtor's)father and wife are universal donees the gift can be treated as nulland void.can anybody advice me in this regard? my email address:kamalygn@gmail.com. thanks in advance
