Varas nond on 7/12 stating aykatra kutumbiya pramukh.

Dear lawyers.

Please guide on below issue .

VARAS NOND in which 7/12 stating अ.कु.पु (aykatra kutumbiya pramukh

ferfar mutation entry 1233 is a VARAS NOND stating only Mr ilyas as अ.कु.पु akatra kutumbiya pramukh after his father died. Hence his Mother plus 3 sister (minor) this 4 people are not on 7/12.

Mr ilyas sold property to Mr khade. Another ferfar 1293 is mutated by thalathi.

But Sale deed was not signed by (mother plus 3 sister(minor) . 

Can Mr ilyas only has authority to sale land to Mr khade? Since he is अ.कु.पु Without including other 4 people. Was there such provision given ?

If I am purchasing land from Mr khade can the (other 4 people ) take action against ferfar nond 1293 and land will go back to them again.

Certainly the 4 legal heirs have their undivided heirship rights in their ancestral land, unless reliquishment of rights are signed by them in fvour of Mr. Ilyas. An appeal by any of the 4 legal heirs to Tahsildar/SDO may jeopardise the sale, as they have their undivided shares in their ancestral land.
