Has covid affected the limitation period in criminal appeal cases in the Supreme Court? If so how much is the new limit?

In reply to your query,

The limitation period when it comes to appeals to the Supreme Court in Criminal matters is 60 days.

The 60 days starts from the date of grant of the certificate by the High Court.

However, keeping the current situation of COVID-19 in mind the Supreme Court has ordered the extension of the limitation period for filling of cases.

The Hon’ble Supreme Court when it comes to the matters of Re Cognizance for Extension of Limitation has decided to restored its earlier order.

This order states to exclude the period starting from 15th March 2020 till 28th February 2022, for the purposes of limitation prescribed under any general or special laws in respect of all judicial or quasi-judicial proceedings.

This was taken with the view of the current spread of the new variant of the COVID­19 and the drastic surge in the number of COVID-19 cases across the country.
