[teacher problems]

Sir
I am the head of a school based in Gurugram with a decent student and teacher population.
I have joined the school recently and have been struggling with this one teacher who is breaking all rules of the school.
This teacher is question is not following the school timings or performing her duties that are expected from her.
It will not be wrong to say that she needs to be terminated. However the Haryana school act prohibits such a procedure and the same is very lengthy. This teacher knows the fact and hence is troubling us to no lengths.
Further whenever we issue her any document she is refusing to accept it. We even sent one document by registered post/courier which she refused to accept.
We wanted her to resign but she is refusing to do so and on top of that is instigating more teachers in the school that even after doing all wrong things nobody is able to do anything to her.
She comes late 75% of the time and has no problem in deducting her salary. When we ask her to do a task she ignores such instructions. The parents too are unhappy with her but not giving it in writing as she seems to be influencing them too.
We want to disassociate her with the school but cannot figure out what to do as she is hell bent on fighting with the school.

Being a Headmistress of the school you have enormous powers to enforce the rule and regulations agaisnt the defaulting teacher.

You issue a warning letter with a copy endorsed to the top mnagement.

If she refuses to accept the warning letter, you can send that copy also to the top management and seek their advise to initiate further action.

You can inform that you have initiated all the actions necessary as per rules, whereas she is not amending herself nor she is cooperating  therefore you may leave the decision on further course of action to be taken to the management and let them pass instrutions on further action, you can follow it stating that you are taking action as per rules and instructions of the management.

You will be safe on one side and the other side you can also take legal action in this pretext.

You simply can post the warnings on the notice board and keep record of that, you have to make a disciplinary committee to enquire about the conduct of the teacher and thereafter you must issue a Notice by passing  the resolution warning her last chance to mend her ways. If she continues like that the disciplinary committee should call the employee and reading the allegations to her she has to be be given chance to prove the allegations as wrong.        Her appraisals should be commented adversely each time and finally she can be give notice of termination. That is legal way to dismiss a teacher on the grounds of misconduct.
