Ajay   23 April 2023

420 ipc procedure

A party has given me a cheque to discharge his liabilities.

I want to file case of cheating against him along with the case of cheque bounce

Is it advisable to file the case of cheating directly in court without going to police station.

As i have complete documents to prove my case and there is no need of investigation.

What will be the process,  after i file complaint case ?

Dear Querist

You are advised to send legal notice before filing cheque bounce case u/s 138 NI Act.

Further advised to lodge FIR at local police station u/s 420 IPC instead of complaint case.

Feel free to contacr further clarifications.
