Ancestral property

my mother should have got some share in her ancestral property , which she never got and almost whole property is sold without her consent . if my mother leaves a will or GPA in our name ., will that be enough for us to ask for her share anytime in future ,my mother is 70 yrs old now .

GPA expires on death.

 You can always start litigation at a later date as heirs, but things get difficult as time elapses. It is advisable to contest in present.

Better to initiate legal proceedings during her life time itself rather than defer it indefinitely.

You can file  suit in her name, and you can  proceed with the same  in future if any things happens,but it is better to initiate proceedings at the earliest.
