Application to set aside OP's documents

My question for learned members is...

Q. Is there any procedure to apply for setting aside any interim order of Consumer Court ?

Facts: In the said matter, when it was decided first in 2008 by District Forum. On final date for oral arguments, the complainant was present when he was called, but OP counsel was not present in the court. So after looking at the order sheet of the previous hearings, the Hon'ble President entered the following in the order sheet:

" Pr. Complainant in person. OP is not appearing for the last many dates. Supplementary arguments filed by complainant. Heard. For orders the case is

reserved.

sd/- President & sd/- Member

Later the counsel for OP appeared and filed written submission along with judgement.

sd/- President & sd/- Member "

The above implies, after the complainant left and the case was reserved for order, how the OP counsel was given an opportunity to file anything, without issue of any notice to the Complainant ?

Just to add to the above...

After the above, decision was pronouned by the District Forum but no any such documents/precedents were referred to in the Forum's order. And after appeal in State Commission, the matter has been referred back to the District Forum for fresh decision based upon some other grounds... the proceedings are yet to begin !
