Fraud in bank account

Sir,

My grand parents expired long back and they have investments jointly in our name but my uncle has few bank account in his name jointly with grand parents. He enchased cheques (from our joint investment with grand parents) which are in the name of grand parents in his joint account after the demise of grand parents.

We have bank details but how to get bank statement of those bank accounts under RTI or is there any way out to get those statements.

If you have joint account you can get the bank statement

Your father and his siblings should file a succession petition for inheritance of the properties (movable and immovable) in their names.

You should instruct your banker to stop payments to "third person" and recover it if some amount has been illegally withdrawn by your uncle, where you are joint accountholder with your grandparents (as stated by you).

However, prima facie it is an unbelievable statement as to the bank(s) making payment to any    "non-account holder"  i.e., your uncle in the instant case.

Since your uncle was the joint account holder, he was able to capitilise the situation in his favor.

Besides in the joint account he is authorised on the basis of E  or S TO WITHDRAW THE AMOUNT, HNCE YOU MAY NOT BE ABLE TO RECOVER THAT MONEY WHAT HE SWINDLED.

As suggested you may obtain a succession certificate but for that you need to have the details of account and the remaining amount in the bank account.

You will not be able to get the information through RTI Act.
