Complaint Under Sec-465/467 of IPC

Dear Sir,

 

                We file a complaint against one person who submited wrong agreement on Rs.20 non-judicial stamp in the Taluka police station under section 465/467 of IPC but the police department do not take any action agains that accused.So now what we can file our case in Civil Court,and we can take any action against police department who favoring the accused.The accused have a good politics support so the police department not take any action against it.What is the after the complaint we can wait for a police procedure.

We can file a case against the court,when we also do complaint against the accused in the police department

Dear Jignesh,

As you are saying that, you have filed a complaint u/s.465/467 of IPC before the Taluka Police Station at initial stage but there is no action against the accused from police department;

 

Now you can file a "Private Complaint" under Section 200 R/W 156 (3) of Cr.P.C for the said offences, before the Judicail Magistrate of concerned Taluka and Police Station, and pray with the court for investigation and report.  In support you can attach the said copy of the complaint filed before the P.S. and mention in the complaint about no actions by the police department on your complaint.

Another thing I want to suggest you, don't make any allegations  against the police, as you are saying that they are favouring accused persion, if you make any allegation and file any petition against the police, they will ask the accused person to move a "Writ Petition" in the state High Court by seeking orders agains  the Police, for there interference, harassment and regularly calling to P.S, as the matter is "CIVIL NATURE".

Dear Jignesh there are number of cases and orders from the several High courts, directed Police department not involve in the "Land Matters" and cases of  "Civil Nature".

In the very same matter I also obtained directions for A.P. High Court on police harrasment and interference, I was appeared and represented on behalf of the accused and there was a Court Complaint and Civil Suit of same nature of facts and offence.

Please clarify how can filing a wrong agreement on a Rs. 20 non judicial stamp constitutes the offence under sec 465 or 467.

for forgery one has to prove 'intention to defraud'. By filing a agreement on a non judicial stamp one cannot prove he has a dishonest intention or a fraudulent intention. moreover has he forged the document. did he sign seal or execute the document making you to believe that it was signed by someobe else.....

Please give some more details...
