Daughter's right over property

Hi,

My grandfather left his property(which was created by my grandfather) in the name of my brother. Now if my father(alongwith my brother) want to sell this property, can my father's sister's cause any issue with this? Do they have right to claim this property.

Above , i'm talking about property in Delhi region.

Thanks,

Gunjan

Dear Gunjan,

To reply your query  very clearly following fact need detail explanations with reference of Documents in the hand and on the name of your brother:

" My grandfather left his property(which was created by my grandfather) in the name of my brother."

By documents I mean Will, in which the property is written in name of my brother.

if the property is your grandfather's own earned and he give the same to your brother by will, then your brother is the owner but by virtue of will at first the property to be made in the name of your brother, for that you have to take probate.

after the property changed to your brother's name, he will be legal owener of the same and can sale to anybody, but not before that
