DEFENDANT VS DEFENDANT

 IN A CIVIL SUIT ONE PLANITFF Vs 4 DEFENDANTS. PLANTIFF DELIBERATELY  DELAYING THE CIVIL SUIT BY NOT MAKING THE SUMMON SUFFICIENT TO THE DEFENDANT NO.3 WITH WHOM PLAINTIFF HAS A COLLUSSION AND THE SUIT TOTALLY LIES ON THE BASIS OF AN AGREEMENT TO SALE EXECUTED BY DEF.NO.3.

IN THIS CASE CAN  DEFENDANT NO.1,3 &4 FORCE OTHER DEFENDANT TO APPEAR BEFORE THE COURT ? IF YES THEN ANY CITATION PLEASE .!!!!!!!!!!!!

PLAINTIFF INTEN TION IS TO DRAG AND IMPLICATE OTHER DEFENDANTS FOR A PROTRACTED LEGAL BATTLE

Dear Sir,

              As per your question Defendant No.2 is not appearing before the court. Plaintiff cannot drag on the case after certain limit as per amended CPC. Time has been fixed in the amendment. The court may set the Defendant No.2 as exparte and conduct the case.

dear suresh sir, could u pls enlighten me the latest amendment in this regard also the maximum time limit for disposal of the suit !!!
