Desertion period required to file a divorce petition under mental cruelty

One year from the date of marriage must have elapsed to file a petition for divorce under section 13(1)(ia).  To file a petition before elapsing one year from the date of marriage, you must file an application to seek permission to file divorce petition before one year from the date of marriage on the ground that you are facing hardship. If Court is convinced, it will grant permission.
