Determination of age as on the last date of application

Dear Sir,

A University run by state Government notified for the post of Assistant Professor on 12-6-14. The last date of submission of application was 31-7-14. Total days given for submitting the application was 50 days. The upper age limit was determined on the last date of submission of application. The statute of the university also precribed thus.

Is it correct to determine the age as on the last date of submission of application for a post, when there is no definite rule either in the statute or Act prescribing the number of days in between the date of notification and the last date of submission of application? 

Will it not be arbitrary to determine the upper age limit based on the last date of application when there are no definite rules specifying the period between the date of notification and the last date of submission of application?

The date of notification is not creteria for determination of upper age limit.  At the time of submission of application whether you are qualified as per age, education, experience if any etc., is the creteria.  See state employees service Rules.
