I am seeking your help to get clarified on divorce appeal proceedings in Supreme Court. My wife filed 498A multiple times and DV case against me and my family members in 2008. I filed for divorce in Family Court, Chennai and relief was not given. However, recently High Court granted divorce on grounds of cruelty as I was acquitted in 498A case. Now, my wife is planning to file appeal in Supreme Court. Could you please help me in clarifying the questions below.
1. When the grounds/law was so clear, still Supreme Court allows the appeal petition? Will there be any filtering criteria like satisfying 'substantial question of law' etc?
2. Do women come to Supreme Court for relief in divorce cases, in general? My wife-side people can spend money to harass me further.
3. What are the typical grounds to accept a divorce appeal by Supreme Court?
4. If allowed, on an average, how many years Supreme Court takes to pass judgement in appeal?
