Domain name hijacking by service provider

Dear Sir,

I would like to know what provisions are available when a domain name registration service provider (Who is also Website Designing Firm) registers a domain name on behalf of his client and put the registrant details of his own. The client being non techncal doesn't understand this and users the domain along with website for four to five years renewing them promptly.

But when the client decided to move it to somewhere else, the original service provider refuses to provide access to domain for which the client has paid for years and is currently active. As evidence the client is having all the email communication, payment receipts.

Ignorant clients are being forced to renew the service with such service providers and when thier brand is buld on such domain names, it is not possible for them to change it.

Are there any examples of such cases in India.

This involves contravention of Intellectual Prperty Rights. As you have already obtained domain name, make a cyber complaint and register the case.

There are certainly some legal remedies under Information Technology Act and you may write to mahendralimaye@yahoo.com for more detailed information.
