Megisterate has discretionery power in DVA 2005,he can order maintainance prior to your say if facts and circumstances are in favour of her. It dpened's on her portray of how much abla-naari she is..

If I am not mistaken, maintainability of any proceeding is an issue of law. In general, an issue of law can be raised at any time in the Indian court systems. Any time, means just that... So, you can file an application questioning maintainability at ANY TIME.  @sufferer appears to have misread your query.

The maintainibility of any petition lies on jurisprudence of Law as does it fit for the fact's and circumstances of the case or not.
