Employer is asking for resign during maternity leave

Respected Advocates & all Consultants,

One of my friend is working in a private limited company since last three & half years & she is on Maternity Leave now.

Her Maternity Leave is going to expired in October-18. Verbally his superior has called her & asked that Management has decided to waive-off the designation, which she holds currently, eventhough two employees of her office promoted on same designation, which she holds.

Now, management want to avoid payment of two months in lieu of notice period, and during her maternity leave they asked that your notice period starts from now & you have to resign after completion of maternity leave.

Instead of giving two months payment i.e. after maternity leave end & for the month of November-2018 & December-2018, management said that we are already giving you two months as per tearms of appointment letter, IS THIS LEGEL? WHAT CAN SHE DO NOW?

Please provide your valuable suggestion...

Has the employee tendered notice of resignation?

Till not, but probably they will email withing next two or three days...
