Eviction of son of expired tenant

The property in question is located in Noth Kolkata and is a three storeyed old building. We used to stay as tenants in the ground floor of the building. In December 2011, my father has bought the entire three-storey building. The 1st and 2nd floors are also occupied by other tenants, who are staying there for about 40 years.

The tenant staying in the 1st floor has expired 7-8 years ago. His wife also expired about 10 years ago. And now the entire floor is occupied by his son and his family (his wife and two children). But according to West Bengal Premises Tenancy Act, 1997, the son of the expired original tenant can continue to stay as tenant for 5 years, after that, if he can be evicted.

My question is, my father has been owning this property for three months only. Can he still produce eviction notice on this ground?
