Execution of gift deed in f/o cousin brother- ancstrl land

LATE RAMAIAH  (DIED) - OWNER OF 15 ACRES (Ancestral Property) partitioned amongst three sons equal.

  • WHEREAS Ramu share – 3 acres, is holding by Mohan s/o late  Bhim as per revenue records (Pass BOOK/title Deed). But in possession is ramu for last 40 yrs.  
  • Now, since the 3 acres are part of share of Ramu,   Mohan S/o Late Bhim wants  to execute the Gift Deed in favour of Chand S/o Ramu to clear partition.  Who is a Cousin brother.

Can Mohan S/o Late Bhim do so or not.   Hope it is valid transaction as there is willingness from Ramu and His Elder son Suraj.
