Extreme misuse of maintenance law

Hello,

Mother has filed a false case against son for Maintenance.

1)      Mother is staying with son, and son takes care of rent and all daily expenses.

2)      Mother has multiple bank account / FDs with balance in lakhs (have relevant proofs)

3)      Mother is also earning and filing ITR (income from interest received) filed 2 yeas back (latest ITR is not filed)

4)      Mother every day does gambles in stock market and have lost lakhs in daily trading  (have relevant proofs)

5)      Father is a businessman, has a shop and earning small money

6)      Son has been making all payment of all hospitalization bills for mother/father which he had taken loan from bank (have relevant proofs)

7)      Son has been taking loan from bank every 6 months (since 4 years) to support family expenses (have relevant proofs)

The intension of filing the case is to grab the property registered in son's name and get more money for gambling in stock market, pls advice what the son could do.

1. If father is alive and earning (whatever minimum to maximum) then in presented brief facts son is not liable to provide maintenance to mother. Infact kick her out (I mean drop her to fathers place).
2. Present all proofs that you say you have at appropriate timing in concerned case.

If your salary is less than your mother then file CrPC-125 case against the mother .... then see what happens. Ask your father to help you.

 

If your mother actually needed money they give her prior to she ask you.

This is not feasible as son must be a major having his own source of incoome .
