False Hiba Claim

Following repeated requests about financial crisis, my father allowed my sister and her family (husband and 3 kids) to stay in our Mumbai flat in 2005 (7 years after her marriage in 1998). My father continued to pay maintenance for the flat as he had since 1978. My father was staying with me and transfered the flat to me in 2008 (prior to that I also had a POA in 2007). The co-op hsg society has transfered the share certificate in my name and I now pay maintenance bills.

Now my sister is verbally and physically abusing me and my father, claiming Hiba (Gift as per Islam). She says the transfer of property to my name is illegal as she is the owner of the flat since 2005 and that my father has lost his mind.

Doesn't a person have to inform the co-op hsg society abt any transfer as claimed by her.

Seems like no one except her knew about the gift (not even my father).

What can I do?
