rent agreement

Tenant not paid rent for 5 months , sent legal notice refused by tenant .Now he is missing since from many days , missing complaint as been lodged ..he as switched off phone ..and as cheated to many people regarding money ,

As being a owner how can I evict him quickly and also shop items left of tenant ,? how to resolve this issue ?

You have to file an eviction suit to evict him by due process of law.

Any other mode may create problem to you.

You can file eviction suit against your tenant on ground of default in making payments of rent and after getting decision in your favour, may get attached his valuables through court.

The notice is stated to have been refused is presumed properly served, file a suit for eviction and recovery of arrears of rent with mesne profits through a local prudent lawyer.

Legally you cannot break open the lock and/or take over the demised premises of tenant without prior permission of Court / police.

Already missing complaint as been lodged against him ,upon this can I file eviction suit ....will the law permit .... after some days he can come defend himself ? please clarify on this sir ...tenant is very cunning

You have no reason to file a missing complaint. 

You have to confine to your relief alone. 

You may consult a local advocate and proceed as suggested
