Dear Sir, I'm a Muslim being married for 3 years and have one baby of 2 years old. Since start, the marriage had complications because of interference of one lady that is living in her fathers home on rent but has no relation with him and my wife obey her more than their father (mother of my wife is already divorced and father is mentally retarded),also her mental level is not upto the mark and she is unable to take any decision and totaly depends on above said lady. I tried with the help of my wife's relatives so many times in last one and half year to let her go to my home as she moved to their parents home one and half year ago but she refused. Now she is neither ready to live with me and neither leaving me. I am worried and I have few questions. Hope some of you would be able to advice 1. If I give talaq after taking the permission from court(If after mediation and case of rukhsati she is not ready to go) , what will be my obligations? 2.my self is government employee and my gross salary is Rs.98000 if she file maintenance what will be approximate amount that court may fix on me ? 3. Even if we separate with mutual consent infront of Panchayat and elders of community, can my wife still go to court and file a case against me. 4. Would she be still able to claim some kind of maintenance for her in event of mutual separation. 5.Can i make second marriage without giving talaq.6.Can she file maintenance even if i will not give talaq.
