Father do not want to give share in inherited property

Respected Experts,

 

 

 

I am from Delhi. We stay in our Grandfather’s self owned house (Kothi) with 3 floors (Ground, First, Second).My Grandfather had 3 children, 2 Sons and 1 Daughter (All alive).  I am the son of his eldest son.

My Grandfather expired in Jan, 2010 & my Grandmother expired in Feb, 2011. The house was divided equally between my father & uncle through Will. No share was given to my Aunt. However my aunt does not agrees with the Will and will be challenging the same. 

My uncle was given the ground floor, my father was given the first floor, and the second floor was divided among both of them. The second floor is been rented out.  My father & my uncle are having their own disputes upon this property. My uncle wants to take complete hold of the second floor and he is also not paying share of rent to my father.

My problem is that my father wants to sell out his part of share & does not want to give me any share from this property. He is forcing me to leave this house and stay somewhere else. As per him he had spend enough on my education and made me qualified enough to take care of me and my family.

I want to know that do I have any right in my grandfather’s property. Can I claim from my father share, which was given to him in my Grandfather’s Will?

Dear Vinod,

The "WILL" has the answer to your query. If your grandfather has given absolute rights to his two sons in the "WILL" then you cannot claim any share as a right. If your grandfather's intention is to pass on the share to you, you may claim your share. Regards
