Can anyone tell me what is the appropriate Forum for filing a Misc. Appeal under the proviisions of Order 43 Rule 1(u).? The suit which i am mentioning here is remanded by the First Appellate Court after framing to additional more issues and in the meantime the Court Fees were refunded to the appellants. So i want to know what is the appropriate forum for filing the instant appeal under the perview of Order 43 Rule 1(u). Kindly provide citiation if possibe..?
