Grant of injunction!

I would like to state that to safeguard the interest of rights of co-owners in a land, I have filed a suit for injunction and partition. It has been filed and given the suit number but a date of hearing has been fixed, 7th January 2017.

What if the other parties with no intention to give the share make any sale deed before 7th January 2017?

What if the other party do not appear on the date of hearing? Will the injunction be granted?

Your stay (injuction) application should have been decided ex-parte (in given circumstances). Even otherwise the courts usually issue notice for appearance on short date and not so long. Recheck with your counsel.

Meanwhile submit an application to area Sub-Registrar about the on-going case for partition and stay of registeration, if presented.
