Indian passport with govt employment details

Dear All,

I have a query with regard to re-issue of passport . One of my relatives who is employed in Govt as teacher has obtained Indian passport without disclosing her Govt employment details & got B1 /B2 stamped too.

Now she is worried about not disclosing this information and hence would like to have her passport re-issued with her employment details disclosed to Passport office. She is a IT assessee and some how made the mistake of getting a passport without identifying herself a Govt employee (teacher) thinking obtaining a NOC would take time.She received her passport 2 years back and got her B1/B2 stamped as well in the same year , but never travelled.

She is due to be retired in October , but wants to re-apply for passport with disclosing her employment details. What kind of problems would surface , I know there is a penalty , but are there any chances of Passport office cancelling her passport for suppression of informaiton when she re-applies.

dear querist,

if you want to disclose any information after obtaining a passport and want it to enter in the passport,you have to get it done through the court,if you try to apply for new passport it is against the law and illegal to apply for new one when there is existing one and if you apply through the simple application in passport authorities for change in the enteries ,it is also illegal as you had taken the oath and affadavit signed during the passport form that above information is correct and you are not hiding the correct facts,you have to done it through court and court will pass orders to the passport authorities to change the enteries and it is well safe and adopted method.feel free to call.

I disagree to SC practicing Lawyer @ Anish bald reply!
Reason for disagreement is that competent Court has nothing to do at this stage as provision of Penalty Clause are per Passport Act is very clear on raised query subject. Pay the penalty first and get the correct entries done at the time of renewal is as simple the Rules is all about for literate applicants.


1. Visitors from India on B1 /B2 visa who are not normally resident in USA are advised to hold passports which are valid for the period of their visit. In such cases, where it becomes necessary due to unavoidable reasons, passport would be reissued after clearance from the original Passport Issuing Authority.

 

2. Passport renewal service is not available for B1/B2 visa holders and temporary visitors to USA. It has to be done in India at RPO jurisdiction PSK.

 

3. Effective April 16, 2012, Indian Passport services (Renewal, extension etc) is now handled by VFS Global. Individuals Indian consulate will no longer accepting passport related services directly. All applications and communication related to Indian passport renewal must be through VFSGlobal.

 

4. Your relative may certainly use the B1/B2 for a visit to her relatives , for tourism, or for business purposes as long as long as the visa is valid.

 

It seems your aunt did not submit "Annexure B" and only submitted "Annexure I" earlier?

Well she needs to met the penalty this time [as per S. 12 (1) B of Passport Act it is only Rs. 2500/- as she being literate applicant] and most probably she may not be able to use her (if still valid) B1/B2 too as Passports issued by PSK are now-a-days intra linked to US data servers as part of US / India bilateral ties on Internal Securities Arrangements ! (double check on B1/B2 validity if renewed with penalty payment from VFSglobal now) J

For obtaining a passport if you are in governent service you have to take no objection from the employer, if you have not done so it is a suppression of fact, and if this think comes to the knowledge of the passport authorities the passport authority has got every right to immediately cancell your passport and you will be criminally liable for it. Take immediate legal step for rectification your submitted details, before any odd thing happens.

Thank you all for your response. We are re-applying for passport by providing the earlier passport details along with her Govt employment details. Hope everything goes through fine.

We are hearing multiple responses on her visa validity. When I called up the  Passport customer care team, they informed me that its left to the discretion of the authorities. Hope everything goes through fine .
