Intercaste marriage.. schedule caste girl and general caste

Article 16(4) will apply to the girl before her marriage. The Constitution is silent on the question raised above. There are many court judgments on the subject, even contradicting  each other. The Supreme Court has introduced the term creamy layer. If due to marriage the girl gets into the creamy layer, in other words, if she is accepted into the family and community of the upper caste boy and enjoys the benefit of belonging to the upper caste, she may not get the benefits given to lower castes. On the other hand if she is ostracized by the community of her husband she may get the benefits.
