advocate fees paid, not attending matter, not refunding fees, what is remedy

paid 50% fees to advocate, is not attending matter in Gujarat High court. is not refunding fees, not claiming balance undue fees not can get NOC as 50% fees being hefty amounts are already paid by cheque. do initiate complaint before registrar, chief justice to direct return full 50% fees amounts collected or to disqualify said advocate on professional misconduct

When you have paid 50% of the fees the advocate is liable to attend, however, if not attended / attending without any plausible cause/ reason you may move to:

a) Gujarat Bar Council (where s/he is enrolled as advocate) 

and / or

b) jurisdictional consumer commission for deficiency of his / her service. 

c) You can also file a suit for recovery of the amount paid

Replace such lawyer immediately with some other reliable substitute even if earlier did not issue NOC. 

Registrar or Chief Justice has no authority / role over the advocate for his /her disqualification or issuance of any such direction to any lawyer.
