Dear Learned memeber,
I am working as HR / Payroll consultant in BPO / ITES company. My employer is not paying salaries to me since November 2010 onwards. ( Salary Due amount for Nov, Dec, Jan is Rs.90,000 / ).
There is no hope to receive any payment from my employer.
Notice period for termination of services as per offer letter is one (1) month.
(1) Does BPO / ITES comes under definition of Industry establishment. ?
(2) Does BPO / ITES employee comes under definition of workmen ?
(3) Can I approach labour court for recovery of unpaid salary amount ?
(4) What is the court fee that I have to pay ?
Please suggest me.
