Is there any law for adjustment in excess salary

My Humble request is consider this question as matter of legality ,ethics is seperate part

 

I had accident ,had admiited for 2 months,company by mistake gave full salary,its a software MNC

now this month I attended office totally still they gave 0 salary

I doubt they will reply as they made adjutsmnt salary,is there any law against it?

The salary slip has to be supplied at least a day before disbursement of wages.

Payment of Wages Act;Sec13A

Min. Wages central Rules; Sec 26(3,4)

 

You may go thru both of these Acts on your own……………………on sections pertaining to deductions.

The salary slip shall show why 0 salary is paid.

The company should have issued a notice before deduction.

If employee met with an accident while travelling from home to work, work to home, on job…………………….the employer is liable to pay for medical expenses………………….

The ESIC, Employee’s Compensation Act also takes care of it……………….

You can discuss in person with your Labor Law consultant/Service Lawyer-Law firm, employee's unions/Work’s committee/grievance redressal committee within company, trade unions like CITU/AITUC/BMS/INTUC................IT/ITeS employees union like:

You will be supplied with the a salary slip every month or the details of the salary will be furnished to you regularly, by which you will become aware of your earnings, deductions, additions, deletions etc. If you did not get one recently, you can very well demand and become aware of the details you are seeking here in this forum.

If it is not true then you should put your objection on record, stating it is false, in writing under proper acknowledgment to good offices of appointing authority, MD with a copy to Head-HR.

You already know the answer?

Doubts apart, let them state so in writing!

 

You can proceed further upon getting a reply.

Silence at your end would be treated as deemed acceptance.

The group insurance policy obtained by company and in which you might be a member, might have a provision to pay compensation during sickness.

 

The employee's/Trade Unions unions can help you.

 

Assuming that you are not eligible the Chairman's office can award you a compensation/ or even full salary during sickness, by its own discretion.

trade union etc are out of picture,company is with high influence till ex-cm of maharashtra

"we got input from hr as lwp days of 31.so as per input we have processed ,for more details contact your people process"

Probably this is a reply by payroll personnel/vendor.
 
 
If salary slip is for month:::X, and LWP are not :::31, then you can represent.

Ideally/legally company should show recovery/deduction under head of recovery/deduction in salary slip.

This is a veiled statement but time tested and conveys a meaning..................

It is felt that you have understood the meaning.

You have to collect the details from your office, it will be internal affair till now since you have not escalated the matter to any legal forum or planning to go legal about it. always communicate to the office in this or any subject in writing and keep a record of all such activities which will enable you to deal with all contingencies that may arise in the later stage.
