a. Leakage Problem
This property is more than 15 years old and for the past two years there has been frequent problem of leakage from 1st Floor. In the beginning of 2010 there has been severe leakage from first floor front side bathroom which resulted in damage on Ground Floor causing a great inconvenience to the Ground Floor occupants.
The residents of first floor agreed to bear the expenses but susequently refused to share the expenses . The leakage is a regular process. Since the wooden flooring and Geyser/Electrical wiring on GF got badly damaged due to leakage from FF and there was also leakage of electrical current in the bathroom and the bathroom wall of the GF. Hence occupants of GF not only had to incur expenses on repair of electrical wiring and Geyser but also had to incur huge expenses amounting to approximately 75 thousand on painting of room/Bath room and repairing of wooden flooring.
However the owners of FF have refused to share refund the expenses to the owners of GF.
Legal Options
Considering the above facts and circumstances can the owners of GF initiate legal action by filing?;
a. Suit for recovery for amount incurred on repairs.
b. Suit for damages for violation of easement rights.
c. Criminal complaint for nuisance.
