Marking Additional Documents as Exhibits

In a Section 138 NIA case, the affidavit in support of evidence by the complainant has been submitted and the case is scheduled for Cross Examination.

The complainant wants to file /mark as exhibit some more documents .

 

Does the complainant possess the legal right to do so?

If YES, What is the legal procedure to do that?

document is irregular cannot be allowed to be raised at any stage subsequent to the marking of the document as an exhibit. The latter proposition is a rule of fair play. The crucial test is whether an objection, if taken at the appropriate point of time, would have enabled the party tendering the evidence to cure the defect and resort to such mode of proof as would be regular.
