Section 31 of the Cr.P.C violates art 14 and 21 of the constitution since it confers uncontrolled discretionary power on the court to decide whether punishments shall run concurrently or not.

SEC 31:: SENTENCE IN CASES OF CONVICTION OF SEVERAL OFFENCES AT ONE TRAIL

 

ART 14::The State shall not deny to any person equality before the law or the

 

equal protection of the laws within the territory of India.

 

ART 21::No person shall be deprived of his life or personal liberty except according to procedure established by law.
